Inheriting Private Property When You Already Own an HDB Flat

Dealing with the loss of a loved one is already challenging in itself, and inheriting a private property might just come along with it. However, if you already own an HDB flat, things could get a little dicey.

Inheriting another home is not quite as simple as adding a new property to your name. You could run into HDB rules, ownership limits or taxes, depending on how you inherited the property and what you decide to do with it.

So before you assume you can keep both, it is worth checking the rules first.

You can inherit private property while owning an HDB flat, and keeping both comes down to whether your flat has completed its Minimum Occupation Period, five years for most flats and 10 for Prime Location Public Housing flats.

The inheritance itself is never blocked, only what you can hold onto afterwards.

The MOP test that decides everything

The Minimum Occupation Period, or MOP, starts from the day you collect your keys. Until your MOP is over, you generally cannot sell your HDB flat or buy private residential property, whether in Singapore or overseas.

This applies to the flat owner, their spouse and anyone listed as an occupier.

The rules also cover more than just buying a property yourself. They can apply to properties held in a trust and even properties where you are a beneficiary.

So what happens if you inherit a private property? HDB can still treat that as acquiring a property.

The key question is when you inherited it and whether your HDB flat had already completed its MOP. That determines which of the two situations below applies to you.

If your flat is still within its MOP

Don't worry, you do not lose the inheritance. The property can still pass to you under the will or under intestacy law.

The difficult part is that you may not be able to keep it. If your HDB flat is still within its Minimum Occupation Period, you will generally need to sell the inherited private property within six months of inheriting it.

Your HDB flat is not the one that has to go. Since you cannot sell an HDB flat on the open market while it is still within its MOP, the inherited private property is usually the one you need to sell.

Before you make any plans, it is a good idea to write to HDB with your dates and explain your situation. These cases are looked at individually, so your timeline may not be exactly the same as someone else's.

And when you are dealing with an inheritance, six months can pass very quickly.

There is another thing to keep in mind. Probate can take up the first few months, leaving you with less time than you might expect to sell the property.

If your flat has passed its MOP

The good news is, if you are a Singapore citizen and you have already cleared the Minimum Occupation Period (MOP), you can generally keep both homes. There is no limit on how many private properties you can own alongside your HDB flat once you have fulfilled the MOP.

That said, keeping both homes does change a few things for you. Here is what to expect.

Your next property purchase could cost more. The Additional Buyer's Stamp Duty, or ABSD, counts your inherited home as part of your property count. So, as a Singapore citizen, your next residential purchase could attract 20 per cent ABSD as a second property or 30 per cent as a third.

Only one home gets the lower property tax rate. You can enjoy owner-occupier property tax rates on just one residential property. The home you do not live in will be taxed at the higher non-owner-occupier rates.

Future housing grants are no longer available. If you own private property, you generally lose eligibility for Central Provident Fund (CPF) housing grants if you later buy a resale flat. Even if you sell the private property, you will usually have to wait 30 months before you can qualify for grants again.

Singapore Permanent Resident (SPR) households are a little different. If you are an SPR flat household, you generally need to sell your HDB flat within six months of acquiring local private property, even if you have already cleared the MOP.

So if you or your spouse is a permanent resident, check your situation with HDB early, as you may not have the option of keeping both homes.

If you inherit an HDB flat while owning one

You cannot own two HDB flats at the same time, so inheriting another flat starts a six-month clock. You will need to decide which flat to keep and which one to let go, subject to the usual HDB rules.

If you want to keep the inherited flat, you will generally need to sell your existing flat within six months, as long as it has met its own MOP and is eligible for sale. If you prefer to keep your existing flat, the inherited one will need to go instead.

If it has already met its MOP, you can generally sell it on the open market. If it has not, you may need to transfer it to another beneficiary instead.

When you are trying to work out which flat to keep, the two MOP dates are usually the starting point. In simple terms, the flat you are actually allowed to sell is often the one that has to go.

HDB may extend the six-month deadline if you have a valid reason, such as genuinely struggling to find a buyer. But do not wait until the last minute.

Ask HDB for an extension before the six months are up, as extensions are considered case by case and are not automatic.

Questions heirs ask

Do I pay stamp duty on the property I inherit?

No. Buyer's Stamp Duty and the Additional Buyer's Stamp Duty (ABSD) aren't payable on property passing under a will, the Intestate Succession Act, or Muslim inheritance law.

However, the exemption ends there. The inherited home counts in your property tally, so ABSD may apply in full on the next property you buy.

I own a condo and I'm inheriting my parents' HDB flat. Can I keep both?

That depends on when and how your parents bought the flat. If it was a resale flat bought before 30 August 2010 without a CPF Housing Grant, you may keep both, provided you're eligible to own a flat and you live in it.

If the flat was bought on or after that date, one of the two properties must be sold within six months. Check your parents' purchase details with HDB before deciding, because the flat's own paperwork decides which rule you fall under.

What if I can't sell within six months?

Apply to HDB for an extension before the deadline passes, because approval needs valid grounds and isn't automatic. A stalled sale despite genuine marketing is the typical reason for an extension.

Will I pay Seller's Stamp Duty when I sell the inherited property?

The holding period is generally counted from the date the deceased bought the property, not the date you inherited it. A home the deceased held for more than four years may attract no Seller's Stamp Duty at all.
